Intellectual Property Rights Policy

Diavolari provides the general public with timeless web design and web development services, with designs made in-house. We have strict policies in place that prohibit and hold accountable any employees or outside contractors that intentionally use content material inside our designs that may infringe on third-party intellectual property rights in the future (for example copyright, trademark, trade dress and right of publicity).

 

Today, there are a slew of resources on the internet that promise to offer "royalty-free" or "free-use" content. The fact that most of it isn't "royalty-free" or "free-use" at all has become an unwelcome and dangerous trend among these resources that provide free content usage. In reality, many of these resources that claim to have 'free-use' content actually have 'copy written' or 'trademarked' information, not "free" as they claim. This heinous practise is swiftly spreading throughout the design industry, putting unknowing users of apparently "free-use" materials at danger of serious violation.

 

We humbly suggest that intellectual property rights holders contact us if they believe our firm has infringed on their rights in light of this new, regretful, and rising practise.

If you believe your rights have been violated as a result of one of our designs or outside contractors, please let us know and we will remove the design from public view and offering (at our discretion) while we investigate the situation.

 

Following the removal of the design, we will conduct an internal investigation to identify what caused the possible violation. If one of our designers or outside contractors is found to have committed a 'intentional' or 'obvious' reckless use of protected property, they will be written up if it is a one-time occurrence, or fired if it is a recurring issue.



Please file a notification to our Copyright Department if you feel one of our designers or outside contractors has deliberately infringed on your intellectual property rights:


A signature of a person authorised to act on behalf of the owner of the allegedly infringed copyright or other rights, whether physical or electronic.



The allegedly infringing copyright, trademark, or other rights are identified.



The URL or product number(s) linked with the allegedly infringing merchandise's sale. Please note that simply putting "www.diavolari.com" is inadequate to indicate what you are complaining to; you must also give links to the precise design or designs in question.




The entries for your name, address, phone number, and email address are all necessary.



A statement saying that you have a good faith belief that the rights owner, its agent, or the law do not permit the work to be used in the manner complained of.



A statement signed under penalty of perjury that the information in the notification is correct and that you are authorised to act on behalf of the owner of the copyright or other rights that is allegedly infringed.
